Gastromedia, S.L. (hereinafter Wikitapas) complies with the requirements established in the Law 34/2002 of July 11th on Services to the Information & Electronic Commerce Society, in the Law 56/2007 of December 28th relating to Measures to Promote the Information Society and in the Organic Law 15/1999 of December 13th, on the Protection of Personal Data and its implementing regulation (RD 1720/2007 of December 21st, that approves the Development Regulation of the Organic Law 15/1999 on the Protection of Personal Data), for that purpose it has created the following terms of use:

These Terms of Use regulate the access and use of the Web Site, including the contents and services placed at the disposal of the Users in and / or through the Web Site, either by Wikitapas, either by its Users or by third parties.

1. SERVICE

Wikitapas mainly offers a free service in which those Users that are registered in the community will be able to share their passion for tapas through the publication of photos, comments, information, etc.

2. CONDICIONES.

The use of this Web Site will be subject to the following Conditions, which can be periodically updated and without notice. In the event that the User decides not to accept these Conditions, he / she shall refrain himself / herself from accessing and / or using the contents and / or services offered by Wikitapas.

Wikitapas reserves the right to improve, modify or erase, unilaterally and without notice, the service and / or contents of this Web Site meeting the most diverse criteria.

The User bears sole responsibility for any the contents and files made available through the Web Site, therefore he / she undertakes not to publish (or upload) any file (that is to say video, audio, text, photography, etc.) subject to the intellectual property rights of third parties, except when the legal owner of such rights has granted him / her a formal license or authorization to communicate, distribute and reproduce the aforesaid materials.

Wikitapas shall not be responsible for the damages of any kind that can be caused as a result of the contents provided or supplied by any third party not belonging to Wikitapas.

If third party services are included in Wikitapas beyond the responsibility of the owner of the Web Site (in an illustrative and not exhaustive way, Google maps, Twitter, Facebook, etc.) the User recourses to the terms of use governed in each one of them, abstaining from its use or access if he / she does not accept the conditions set by the owners of these services.

Use and Custody of Usernames and Passwords.The User undertakes himself / herself to make a diligent use of his / her password and username and to keep them a secret. The User shall bear sole responsibility for maintaining the confidentiality of his / her password, and shall therefore assume responsibility for any damages, costs and / or harm of any kind that might derive from any breaching of this obligation or as a result of revealing the password, as well as any incorrect use that a third party may make of this, as a consequence of his / her failure to maintain its confidentiality.

Cancellation of the access, services and contents. Wikitapas may, at its sole discretion, deny, withdrawal, suspend and / or block at any time and without the obligation to provide prior notification, the access to contents or the rendering of services to those Users who fail to comply with these Conditions. Moreover, Wikitapas is entitled to erase their account and all information and files relating to this, or, if appropriate, deny their access to such files or to the service itself. Wikitapas shall not accept any responsibility for cancelling the access to the service. Wikitapas reserves the right to limit access to certain services, totally or partially, to specific Users, as well as to cancel, suspend, block or eliminate certain types of contents through the use of the appropriate technologic tools available for this purpose, should it discover that the activity or the information stored and / or disseminated is illicit or damages the properties or rights of a third party.

The User acknowledges and accepts that Wikitapas reserves the right to cancel the accounts that have remained inactive for a period exceeding 18 months.

Communications and notifications: All communications and notifications shall be considered to be effective to all intents and purposes when these are sent via email to the email address provided by the User. The User commits himself / herself to inform Wikitapas about any changes that might take place in his / her personal data and in his / her email address owned by the owner in order to inform the User about the events he / she considers appropriate. The User expressly recognizes that such data has been supplied by him / her and that it is completely true.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

All the contents provided through this Web Site including without limitative character texts, graphs, images, the design and the intellectual property rights that might correspond to those contents as well as all the brands, commercial names or any other distinctive sign belong to Wikitapas or to its legitimate owners, being all the rights over them reserved. Wikitapas shall not be liable for any damages that might be caused as a result of the use of the contents by the Users or the infringement by them of any regulation in force.

The User grants to Wikitapas’ owners a worldwide license, free of charge and not exclusive, for the maximum period of time allowed by Law, to carry out any reproduction, broadcasting, public communication or distribution of the files in any type of medium provided by him / her through the Web Site. Through this cession, the User grants Wikitapas the possibility to sublicense the contents. Likewise, the User gives his consent so that these contents can be modified to add them information or to transform them in order to adapt them to the web’s technical needs.

4. MINORS

Adults are fully responsible for determining the specific contents and services accessed by minors in their charge. Minors under 14 years of age are prohibited to access and use the Web Site. For this purpose, the necessary measures have been adopted in order to avoid any modification, loss, processing or unauthorized access to personal details, in accordance with the technology available at each moment in time. However, the User must be aware that Internet security measures are not impregnable.
